Hi Members,

I landed in US on 14th October applied for an SSN on 24th, although it is still under processing. That means I am not allowed to work till I get my SSN.
As soon as I get my SSN I will start working somewhere. Say I start working from 15th November and get my first US salary on 14th December. Then what would be my status from 14th October to 14th November i.e. the days on which I didnt hold an SSN and so didnt' work.
Also is my employer liable to pay me from 14th October to 14th November(the period I am on bench and without SSN).

First of all, you can start working without SSN. SSN is not a mandatory document for starting work. Only issue is that your employer has to make payment without recording SSN against you name (which is not a big deal anyway).

In general, when you enter USA on H1, you need to start working immediately to maintain H1 status (even though a few days delay is OK). If you did not work from Oct 14 to Nov 14th and did not get paid, you were out-of-status for that period.

By law, your employer is liable to pay you from the day you entered USA on H1 (again, a few days delay should be OK, but certainly not months).

I will ask my employer to act on this. Someone told me that they cannot run the payroll without SSN. Although later when I get the SSN they can include the bench period in the first pay. E.g. a salary from 14th Oct to 14th Dec.(including the bench period 14th Oct - 14th Nov), but I am not sure if this salary should be of 2 months or lesser.
