This is in regards with my friend who is applying for a L2 VISA. His question is below
I have a visa interview appointment next week for L-2 Visa.I worked in USA on a H1 B Visa in 2001 and returned to india the same year.Again in year 2002, i appeared for F1 Visa interview and during the F-1 Visa interview my H1 B visa WAS CANCELLED WITHOUT PREJUDICE.(Reason being I didnt work with the employer who sponsored my H1 B visa during the time of F-1 interview).Also my F-1 was refused.Now, i am appearing for L-2 Visa next week and i have doubts while filling the DS-156 form field Number 35 (Has your US Visa Ever been Cancelled or Revoked?). I am not sure as to whether i should put a YES or NO for this question as my visa was cancelled without prejudice. There is no clear guidelines on whether i can put NO if my visa was cancelled without prejudice.
Putting a YES gives a negative feeling as most of the sites quote for the Item 35 of DS 156 as "USCIS or State Department may have cancelled a visa if they discover that the visa holder has violated the terms of the visa,such as overstaying. If your visa was cancelled before, it would be difficult to get another visa this time"Any thoughts on this?
