View Full Version : Parents Visitor Visa Rejected 1st attempt:214(b)

Hi Senior members,

My parents attended an interview at Mumbai Consulate in September 2006. My father has mentioned in DS-156 that he is employed with 'abc' company since April 2006 as he just joined that company. (Father had employment and leave sanction letter from employer) So when consular officer looked at the date, she told how can you get a vacation for six months with your six months job? My father told her, he has a good relationship with owner. And after couple of question, she rejected visa for my parents on 214(b).

I am reapplying for them. And consular officer will definitely ask my parents why your visa got rejected last time. And I think they might have some kind of note in the system that says the rejection reason. So this time also my father has been working for 7 months with that company. Therefore, how can my parents present themselves so that they can get visa? One thing I can do, this time I can try to get visa for less than 6 months (say for 3 months). Is it worth to proceed in that way? I am afraid in doing so, consular officer might ask my parents why would you need visa for six months before and this time for 3 months only.

Please help me. It's urgent.

I think , asking for 3 months with 3 months of leave letter may help.

you have to be kidding.....first, nobody on the job for a few months can take 6 months vacation....second, after their initial 6 month request, if they return and think they are going to fool the VOs with some silly 3 month request, well, that would only be about the 3,589,989 time the consuls have seen that "strategem."
And no one gets a 3 month vacation from a job they have held for moments...
and the VOs know perfectly well that most visitors are routinely admitted for 6 months, so claiming they will only stay 3 is laughable.
There are far too many holes in this story, and none will be patched up by this transparent claim to want to stay just 3 months instead of 6.....:p

It looks strange to get a leave for 6 months within 6 months of joining the company. I think the answer from your father should have been 'they granted me the leave and will hold the position for me, but they will not be paying me for those 6 months. Since the company doesn't pay me any way, they don't have an objection in me going abroad for a few months. They will hire a temporary worker for those few months to do my work until I return'.

Changing from 6 months to 3 months is okay. I don't think the VO will ask why did you change? Each individual's preferences would change over time any way. You dad may have planned to stay in USA from Sep to Feb as he needs to return to his home country by March for anothe pre-planned event. But, since his new appt and travel dates are now moved to Nov/Dec time frame (for example), he can only stay for 3 months as he needs to return by March for a pre planned event (ex: to attend a family member's or relative's wedding etc in March). Hence, each individual's preference and travel dates/timings will change according to his convenience. But, your dad shouldn't say 'I reduced it to 3 months just to increse the chances of visa'. He must provide a valid reasoning on why/for which event he is plannig to return to India by so-and-so date due to which he had to reduce the stay in USA from 6 months to 3 months...

the VOs will be hard pressed to keep from laughing when they see '3' months instead of the previous '6' month request.....really...that is the single most common futile thing an applicant can do to try and fool the VOs....next to phony bank statements, this amazing change of mind is the #1 thing people do when they reapply....guess what the chances of success are?
About the same as Jobosale being elected president.
And some letter claiming the applicant can take off for six months (oops, only 3 months....) after being allegedly on the job for a few months is about as valuable as two year old newspaper.

You may not like it, but my advice is to wait at least an year for next appointment, that will improve the chances of getting visa. If you send him now:

1. Visa officer does think that your dad is very desparate to go to USA.
2. VO does not see any status change.

I sent my parents within 2 months gap each time after their first visa rejection and got rejected immediately based on above tow reasons (without checking any documents). I waited for year for the 4th interview and the have got the visa 4th time with out much trouble.

so what happened ? In the second interview did they ask about the first interview and what changed ? What did ur parents reply ?

I am facing the same situation and want to know what exactly happened during the second interview which lead to the rejection.

Please share the experience and thanks for the same.

In the sencond interview VO asked only two questions:

1. Why did you come immediately?
2. How did you get 6 months leave for the vacation.

That's it, no more questions and VO does not bother to listen the answers.

My parents went third time after couple of months gap, VO asked only one question: I dont see any change in your status, why did you come? No more questions.

So I waited for one year to take the 4th appointment and by the time they appear for visa it is almost 18 months. This time the VO is very cool. Please see the thread for 4th interview details I posted.

this is exactly what I mean....having one's parents show up a month later with the only change being the amazing change of the time of the proposed visit from 6 months to 2 or 3 will only shorten the second interview....and the last poster is largely correct...the first question asked will be.."what has changed in your situation during the last 4 minutes?" and secondly, "last time you wanted to go for 6 months, now only 2 (or 3)....why this sudden change of mind?" and then, the end.

Yes. Second Interview is over. It was more like a first interview . VO asked questions like it was first interview with no references to the previous rejection. Bunch of standard questions

who is in us
what is the purpose of trip
what kind of work did u do
how much pension do u get
any other kids

that's it. vo did not want to see any documents for proof.

The cases are too random and depends on a lot of factors - like facts from ur side , application , confidence in answer etc.

I am glad. Waiting for passport to arrive.

For my part I plan to still continue to look into this forum and share my experience whenever needed.
