View Full Version : Visitor Visa - Rejected - First Attempt

Hi All
My parents appeared for VISA interview yesterday 26th Sep 2006. They had all documents in order and answered all the questions to the satisfaction of the VO.
Then the VO asked them to show property documents. My dad showed the property affidavit that was notarized in a bond paper. He had all supporting original property documents. Before he can show those the VO rejected the VISA app and gave my parents the 214b rejection letter. That's it. The VO did not even ask for the original documents / proof.
Could someone answer the following questions.
1. Is the property affidavit only optional incase no originals are available and should we always show the orignal property , savings bank details etc FIRST ?
2. Do we have to book a new appointment with a new HDFC application fee ?
3. Can we book an appointment immediately or should we wait for some time before we book an appointment ?
4. When they go for the second interview will they refer to the first one and ask why that got rejection . If so what would be the right reply to that question ?

Affidavit is good enough , the rest of the documents can be shown if asked for

Yes, You need to get a new HDFC receipt and take a new appointment

Technically, you can book appointment immediately. But I would suggest that analyse the scenario, go over all the questions and answers with them and make a decision

Yes, this is one of the possible questions they might face. They need to be prepared to answer this. Again this depends on case to case. Search this forum to find how others have handled these type of situations

The applicants will normally not be asked why their previous application was denied - that information is already available to the consular folks -- they could be asked what has changed in their situation since the last application....that is certainly possible and likely.

The affidavit was prepared correctly in a bond paper with a notary sign. My dad had all the original property and bank papers with him and was waiting for the VO to ask for them , instead of giving all documents . But without any response the VO got the 214b form and said he is rejecting the VISA. No reasons were given.
I am not sure what went wrong.
In the next interview if they ask what has changed since then can we say that we assure them of return and have property , pension , bank accounts and a unmarried son who is living in INDIA.
or can they say that they are not sure why thier first VISA was rejected ?
Please let me know your opinion or share ur experience regarding this scenario.

to the OP: what is your status in the US and how did you acquire it?
Again, they most likely won't be asked why their last request was denied, but instead might be asked what has changed in their situation....an answer like " We promise to return" isn't considered a change nor an answer that has any value. Something triggered the denial...did you leave the country with, say, a tourist or business visa and then did not return? If so, they may think you are trying to get the rest of your family to the US (a common tactic)...

What is OP ?
I am on H1 and here legally as an employee of an MNC. I have been on business visa several years before and returned within the i94 is over.
So I don't know what would have triggered the thought of my family trying to immigrate . I understand that this is the presumption that the VO will have before any interview starts and the applications need to convince by means of facts that the presumption is not true in thier case.
But do you think that when the VO asked for property documents and parents just showed the affidavit taken from a notary instead of the originals ( they had them but were waiting for the VO to ask ) caused the VO to think the "TIES" is not enough and hence the 214b ?

the property documents didn't have a lot weight...something else must have triggered the denial...perhaps a slow answer or an evasive one....:o
