View Full Version : Visitor visa extension for my mother

Hi

My mother is currently in US and has got her I-94 till Dec 13 2006,I would like to get it extended till around Feb 13 2006,since I can take my vacation at that time and that way we could all go together back.

I would like to know if

1. Filing form I-539 for visitor visa extension is the only way? What happens if the extension requested gets rejected? Does the multiple-entry visa get cancelled?

2. Since,my mother has a 10-year multiple -entry visa,can't we just go outside US ,say Canada ,just before the I-94 expires and come back in ?

Any advice on this issue is highly appreciated.

I dont think you need to apply for her visa extension as she already has multiple entry visa. But yeas u can renter again from Canada and they might stamp her I94 for another 6-12 months. since she has already been granted a multiple entry visa her request genarally doesnt gets cancelled except in case of anykind of criminal cases, etc. the thing is she might renter from canada but u need to chk ur visa if u can renter from canada or not. Tlk to a lawyer before you guys leave for canada/anywhere else.

I need one more clarification , what do you mean when you say check ur visa before leaving for Canada? Do you mean if I have a valid visa to re-enter?

I do have a valid visa stamped on my passport to re-enter USA and as I have specified my mother has a 10yr multiple entry visa also.
