Hi Members,

Im working in India as a System Analyst (Administration type profile). I am not much into coding but the plan was to find a programming job when i land in States, hence leaving behind my current profile. So my consultant was supposed to file my H1 with my current Admin profile (as per my resume).

When i received my papers from the consultant, to my horror i found that he had filed my case as a Computer programmer which is not reflected in my resume at all.

Am i in deep trouble for the Consulate Interview here?

The Occ code is 030 in the LCA which i assume means any profile related to computers but the position in the Offer letter and letter supporting the petition is Computer Programmer Analyst.

I really need help in this one Sir.

Truely,
Mansi

All desi consultants no matter what your qualificatioins is Do the H1b as a Programmer Analyst

1) Did the consultant change your resume
2) as the H1b is filed under Programmer Analyst the questions can be asked in that fielld
3) did the consultant give any offer letter and any job descriptions and duties?

My guess you may have to go with the job description.duties given the the offer letter

Hi Aditya,

Thanks for the reply.
No, the consultant did not change my resume at all.
Yes, he gave me an Offer letter with job descriptions and duties which are programming related only. Although he didn't mention any specific technology on which I will be working.

Can these docs be changed as Occ code 030 in the LCA means any profile related to computers.
Even if i go with the job description, duties in the Offer letter and the VO asks for my current profile (that means the current employer letter)...then it would be a mismatch and I will be in trouble. What do i do?

Is there any workaround???

hi there is no relation between the docs u sent for the petition and the docs u will take for the interview
VO cannot find out whaT
was the docs used while applying for petition so u can change the docs now for interview

You mean to say that I can ask my Consultant to change the letters accordingly to match my current profile type ??? That might mean that he will have to touch I-129 (and supporting docs) too.

Please clarify...

I will suggest not to worry about these fine details. CO usually don't go for technical details. Just tell whatever ask for? Don't explain too much and don't lie.

Thanks for the reply Simran...

The thing is that if the VO asks for my current resume/skills then i will be truthful and tell them about my skills and then if he sees that the US Consultancy is hiring me for a Programmer Analyst which mismatches my resume/skills then I think i will be seen as a fraud case.

I am really really worried..

For h1b purposes, all that matters is if you have the qualifications and experience to do the job of a programmer analyst. It is ok if you don't explicitly have Programmer analyst on ur cv.

Ronline, I do not have experience as a programmer. I am into System Administration type job(3 years work ex). My Engineering degree is a 4 year Information Technology course though.

My Current experience is NOT related to programming and in the approved papers that the Consultant sent, my duties and responsibilties clearly reflect a programming job (though no programming language mentioned).

Hence my resume and Employer letter from the current Indian company reflect System Admin duties which is a mismatch with US employer duties.

Please have a deep look Sir. Its a question of do or die for me.

First of all dont worry that much as u r doing...
Does ur petition which ur employer have filled have specific skill sets like coding languages databases or smthing else .....is there is any thing like this in the petition? if it is not in the petition...then i believe the only point of concern is ur designation....although for this also u dont haveto worry!

Does ur employer have send u any letter which states ur job responsiblities....does it states anywhere that u gonna do coding /dev stuff......when u was interviewed what job responsiblties did he explained...u

Hello Seeker,

The petition does NOT have any coding language or database mentioned...but there are duties and responsibilties which are of a programmer, so designation is not the only part to be worried about..

Yes it states that I am write, test, maintain programs.

Please reply...

Thats what i am telling u ...u can always say that u have worked on customizing softwares...manily scripting ...specifically speaking if u r from networking background/system admin background...people do such things...and having a designation of program/system analyst ...is not a surprise...so dont worry ..be confident explain what u know...dont mention terms which u dont know...it would be all good...gud luck

Hi Seeker....

Do you suggest manipulating the resume a little bit for that? Another problem is the employer letter that my current Indian' company is giving me. It won't have scripting and customization of softwares written anywhere in it as i simple don't do that although there lots of administration tools/softwares on which i work. So what do you think?
