View Full Version : please suggest- changing employer after 2 weeks client

folks,
this is my third week with client, i am on my first month of h1b employment.
i have some issues with my employer, so i looked out for a new employer.

I suspect i wont be getting paystubs, as my employer hasnt yet processed my payroll.

the new employer says, he verified with his attorney,such that my transfer without paystubs will be successful, after i work with client for 2 weeks, which i am already

he is going to file my transfer by next week.
My question is, by the time my transfer is filed, i would be reaching my first month of h1 employment. In that case , dont i need payslip?

But the new employer says that if i am with the client for 2 weeks, then it's my employer's responsibility to pay me ,
so even i dont get paid, my transfer can be done.

Is this true? please suggest me,

Paychecks are must to validate ur current H1b status.
Its a risk if u r doing Xfr without paychecks. If u want to do, u can do it without the knowledge of ur current employer. But don't resign until unless ur Xfr is approved.
Also u can use Premium processiing which will take 14 days to know the result

One more thing to look out for is whether u have signed any kind of documents/contract with ur oresent employer and / or if ur new employer is going to ask u sign for him. Pl. beware that any docs. /contracts u signed which has liablity clauses/non-compete clauses can land u in soup- so tread carefully and go thru ur present employer docs. hope this helps. and for H1 transfer u will need all the copies of the docs of ur original H1 filling
