Hi,

My mom was denied visa twice(2nd and 3rd time) , the reason given both times were same.

when she applied for the first time she was granted visa. But she couldn't travel to US because My dad fell sick and she stayed back with him.

Second time her application was rejected saying that she wasted the earlier granted visa, and also she doesn't has strong ties back to India. My sis and bro are in India and she stays with my brother.

Third time (aug 09) her application was rejected for the same reason.

Strong ties back to India is the acceptable criteria, but she didn't travel when she was granted the visa was the primary cause for the denial.

I am wondering isn't this unfair to reject visa applications because they didn't travel when they were granted visa. In my mom's casae my father fell sick immediately after she was granted visa. What is someone expected to do in this situation, stay back and take care of your husband or travel to us because you were granted visa?

My dad passed away in NOV2004.

two times rejection is little demotivated my mom.

Please, Need some insight into this case.

Thanks in advance

Your time is highly appreciated.

Hi,

Sorry to hear about your father’s demise. I think that is the reason behind the denial than anything else. I don’t think they would reject a visa based on the fact that she ‘wasted’ the first visa. When the applicant paid her fee in full, it is not their business whether the applicant ‘used’ or ‘wasted’ the visa. But, as expected, that will be their first question when she applies for the visa next time. I know how hard it is on your mom to go through all this.

I wish you good luck for next time!!

- Jaya.

Hello, I am sorry about your situation. I have to agree with jaya. Saying that your mother "wasted" a visa is a poor excuse..and just that..an excuse. As long as they get their fees, not only is it not their business, but why should they care if one goes to US or not...Wonder if they think the economy is losing out since someone with a visa did not travel there. There are a lot of visa denials I have read about on these boards given to widows. I suppose they feel they will want to stay in US. I feel for your mother, as being rejected like that has to affect her.

Best of luck in the future...
