View Full Version : Can I apply for L1 when I have got 221(g) for H1

I applied for H1B through a consultant,say A and appeared for Visa interview in FEB 2006.I was given 221(g) asking for additional information.The consultant is still trying to get the required documents .

Now my present employer,say B, is asking me to apply for L1.I have been working with my present employer for more than 3 years.

1)What are my chances of getting L1 visa when my H1 has been refused under 221(g).I appeared for H1b in Feb2006.

2)When I appear for L1 visa interview,In DS-156 form, there is a question " Have you ever been refused a US visa?". Do I have to mention here that I appeared for H1B and got 221(g) form.Does getting 221(g) form mean "REFUSAL OF VISA" ?

1. Yes you ,ay apply, Each visa catergory has its own critiera for qulification/visa grant.

2.221g is not a pur refusal, however since I dont know much details abt your case, you should openly discuss this with your company legal advisor handling your L1 case.
