View Full Version : If Visitor visas ext rejected then 10yr visa invalid?

Hi,
My parents are on visiting visa in usa. I went thru this forum and found out that if vistor visa extension is rejected, then 10yr multiple entry visa would be invalid. Is it true ? I could not find this clause in ins website.
Is it a good idea to leave USA before current i-94 expires and come back again after a month? would there be any restriction on how long they should wait to come back to USA for a second visit ?

I believe YES to the first qn.
Its better to leave before the I 94 expiry date. But atleast 6 mths gap is recommended between visits. Its up to the POE officer. He/she may ask why u coming back so soon. If u have a valid answer u will get 6 mths. Otherwise they may give u fewer mths.. Again, we can't predict the outcome in each case..

If u leave us prior to expiry of current I94 u can enter anytime - If the pending extension is eventually approved, u can still stay beyond the current i94. If it is denied u have to leave as soon as u get the denial notice.

Hi,
If visa extension gets denied, then 10 year visa would be invalid. Does this mean, applicant has to go thru visa interview again ?
Please let me know what are the other consequences if extension is rejected.

it depends on how soon u depart the us after receiving the denial notice from uscis. There is no clear info as to when 222g applies, the day u get the notice or the day after ur i94 expires.
in somes cases people have departed within a week of getting denial but the visas were not cancelled. (222g did not apply)
U may call the uscis toll free number and check if they can help u with ur case.
