I came to USA in May 2005 in H1b for the Company A. My visa is valid till Aug 2007. My family came to USA in October 2005 in H4 visa and their visa is also valid till Aug 2007.

I have changed my employer (B) in Dec 2005 and i am working in their client place. I have the valid H1b approval for the employer B.

But my visa in the passport has employer "A" name.

Now i am planning to go to india for 1 month vacation. Can myself and my family re-enter USA using the same old H1B & H4 visa, which is valid till Aug 2007 ? (OR) i need to stamp in the US Consulate in India before coming to USA using the new Approval from Company B?

I would like to re-enter USA without any problem and continue my work with my new employer B.

Some people advised me to go to the USA Consulate in india in Emergency appointment and get the visa stamping before come here. Am i eligible to go through the emergency appointment?

Is it required to go through emergency appintment?

If i re-enter USA with the old visa, do i need to show the new h1b approval (from employer B) with the immigration to get my i-94 at the port of entry?

Yes you and your family can enter US with your old visa.

Its upto you if you want to get new visa stamped.But if you don't then you have to carry new I-797 and show the officer at the Port of entry so that you and your family get I-94 based on your new petition.

You can get the emergency appt if you plan to get it stamped
