HI Guys help me out:
I landed in USA on 28 th April.I am working for company A and I got a JOB in company B. They have filing H1B transfer for me. But my Family has been already stamped for H4 with previous company.

I will join a company B in three weeks

Question :

Does my family has to go again for H4 processing for company B ?
OR
My Idea is to call them as soon as I join the company B ( Probably in two weeks )and once they are here then we file for H4 transfer , is this possible ?
OR
They have to be here before I join the company B ?

Any answer will highly appreciated.

u don't need to do transfer for h4 if primary h1 changes employers as long as the h4 holder has a vaild i94 that is not expiring very soon.
note that i94 determines status in the US. if the h4 i94 is close to expiry, u can file extension along with ur transfer using form i539

they can travel any time even before u switch employers

But they are in India right now. Hence they do not have I-94 yet. Basically we planed to come togather but due to some reason I come first. And mean while ( after first Pay stub ) I am going to get H1 Transfer. My Idea is that they join me once I am in new company to save relocation charges.

Is this possible that they can come on old H4 ? ( I want to call them after two weeks of joining new company )

Any help will be appreciated.

You can call them whenever you want.Just be sure they have the new I-797 and copy of new appt letter
