I am working for an Indian company at India. Right now I am on Business visa in US. Before coming here I submitted my papers to my company for H1 filing when the cap opens on 1st April. I will be going back in 3rd week of April now and they will be filing my visa only after I go back.
To avoid risk of loosing the quota limit, I have decided to file for my H1 through a consultant in US who is ready to file while I am still in US on B1 visa.
But once I go back to India in 3rd week of April, my current employer will be filing my H1.
This way two H1 will be filed in same year 2006.
Is it legal or will there be any hassles if USCIS comes to know of this?
