View Full Version : Visitor visa extension stay

My MIL who has a 10 year multiple entry visitor visa is currently in US and her I-94 is going to expire on Feb25th. We applied for six month visa extension and received a case number from USCIS on Jan 24th. We haven't received a decision on the case yet. Status check on the case tells that it may take a while(can go up to 120 days) for processing the case. My question is can she stay in US until we hear USCIS decision on the case or should she leave the country before the current I-94 expires.

Please advice. Also can any one tell me the time it took to get the decision recently.

she can stay, till you hear the decision But in case it denied it may be a negetive point against her reacord and may cause some problem in her next visit or next visa.

The time depends on the processing center;s processing time.
