H1B application OPT related question

Hi

My OPT expires at the end of July 2006. If I get a H1B in the next fiscal year's quota, it will have a start date of Oct 1st 2006. So will I be out of status during August and September 2006? I read about grace period for OPT. In one place it said it's 60 days from either the end of OPT or the program completion date whichever is earlier. My program completion date is definitely earlier than the OPT end date. It's probably december 2005. Does that mean that I will not have any grace period? If so I won't be able to stay in USA right?

And if I get a H1B early with premium processing but ofcourse still with October 1st start date, will I have any problems when coming back to USA in October, assuming I would have to go back to India at the end of July 2006? I am not exactly sure, but I think i will need visa stamping and passport stamping, right? So will I be able to get those stampings while I am in USA, ie, before July 2006?

I think your o similar questions have already been answered in this forum. As long as you file your H1 prior to expiration of your OPT or grace period after OPT ie your H1 is under processing you can work here in US. But incase your OPT expires before you can file for the H1 options: - 1.) You can go back and wait for your H1 to come thru and aplly thru the consulate, 2.) apply for another course ie you keep your F1 visa valid till your H1 gets filed.
